I Had a Car Accident Today!





So today at lunch I decided to head up to the little town I work ins gas station to grab a soda and a bad of chips to munch on till I got home for dinner. When I go there the gas station was super busy and I pulled into the parking lot straight ahead to my parking space. As I was pulling in and only 2 feet from the concrete block the guy next to me opens his door and takes out my mirror and slightly dents and damages my passenger door. His door is pushed in. The police are called and show up. Wow guess what a jackass for a cop. And the best thing was the guy that hit me worked for the state police cause the Hamel cop asked him what do you do with the state police? Well the cop asked what happen and the other guy said what he had to say. He asked me if I was parked and I said I'm not sure if I was totally parked but I am at least in my spot when he opened his door. He says to me if you wasn't in park then its your fault, and if you see where my car was I clearly was already in my spot just not all the way in park when he opened his door and hit me. The next thing he looks at both cars, not seeing all the damage to mine cause the mirror hanging down is blocking the other damage, says well there is not enough damage to either car that we even have to make a report. Well I had already talked to Doug and he already spoke to our insurance company and she wanted a report and to call her after I got it. So I mentioned it to the officer and he again says well its not necessary, so I say well this car is not in my name its in my husbands and I know hes my husband but he makes the decision, so he says call him them. So I do and Doug says yes he wants one. At this point the cop is not a happy camper. But while I was on the phone he talks to the other guy again and he mentions that there is video and he will just watch the video and see who is at fault. The officer goes back to his car, writes up his forms, asked me if I was wearing a seat belt and goes on with his business. Goes in the gas station watches the video and comes out saying and pointing out on the paper work that was already filled out from before he went into the store that I am car 1 and he is car 2. Car 1 is at fault, like he had it set in stone that I was at fault. But anyway he says that I was coming in to fast, faster than normal cars do and I hit his door as he was opening it. And that he had already been sitting there for 14 minutes before I pulled into the spot. If you look at the pictures his door is bent in where he opened his door and it went past my mirror which took it off. If I hit his door it would have bent out and buckle on the outside.

I know it’s a bit late, but I think you have a say about what happened. Even if you’re at fault and not in the right position, you can still defend yourself. The accident could've still been prevented. The other driver was aware of your presence but still, he opened his door and damaged yours. And since he was there 14 minutes ago, he should have at least told you that you’re not on the right spot.
